Selling land to data center developers

A credible sale package separates verified facts from assumptions. Buyers need to understand what can be built, how power will reach the site, and which decisions or approvals control the schedule.

  • Power: requested and studied MW, ramp, service date assumptions, utility correspondence, upgrades, and outstanding conditions.
  • Fiber: provider evidence, routes, diversity, easements, and extension requirements.
  • Zoning and county posture: permitted use, required approvals, adopted policy, setbacks, noise rules, and the current application record.
  • Water: the cooling concept, documented supply and wastewater options, and permit or capacity dependencies.
  • Land: usable acreage, parcel shape, access, topography, environmental constraints, and room for infrastructure.

For a public example of why local review matters, see Loudoun County’s data center land-use guidance. Requirements are jurisdiction-specific; check the current county record for the parcel.

How we run a sale

  1. Diligence

Assemble title, survey, site constraints, utility evidence, approvals, and a record of open items.

  2. Packaging

Prepare an evidence-based opportunity brief and controlled diligence materials.

  3. Buyer outreach

Match the opportunity to buyer requirements and coordinate questions, site visits, and feedback.

  4. Terms and execution

Compare option structures and fee-simple purchases, diligence periods, power contingencies, milestones, and closing conditions with the client’s advisors.

Make the power claim precise

Read powered land versus land near a substation and the will-serve capacity letter checklist before describing a site as power-ready.

Frequently asked questions

Is my land suitable for a data center?

Screen the site against buyer requirements for utility demand and timing, usable acreage, fiber, zoning, water, access, environmental conditions, and local policy. Request site-specific utility and county evidence before treating nearby infrastructure or a land-use label as proof of suitability.

Should I sell, option, or ground lease my land?

A sale can transfer ownership and concentrate proceeds at closing; an option can give a buyer time to resolve diligence while the owner’s land is tied up; a ground lease can retain ownership with a long-term income arrangement and continuing obligations. Compare control, timing, counterparty strength, conditions, and downside. This is a business perspective, not legal advice; have counsel review the structure and documents.

What is my land worth for a data center?

Value depends on evidence about deliverable power and timing, location, fiber, usable acreage, zoning, water, and buyer requirements. A site-specific diligence and market process is needed before proposing a value; proximity to infrastructure alone does not establish a powered-land price.

What is powered land versus land near a substation?

Powered land should be described through a documented utility service pathway, including capacity, timing, required work, and conditions. Land near a substation describes location. It does not establish spare capacity, a reservation, an approved connection, or an energization date.

Do I need a will-serve letter before selling?

A sale can be structured while utility diligence remains open. A current, site-specific utility letter can help buyers assess the opportunity, but its wording and conditions matter. The sale documents should identify outstanding studies, approvals, agreements, and power contingencies.

How long does a powered land sale take?

Timing depends on buyer diligence, utility studies, entitlement, title, site control, and the transaction structure. We set milestones for the sale process and distinguish the closing schedule from the utility energization schedule.
